This binding legal document outlines the data processing practices of UNFILTERED in strict accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and all applicable laws of the Republic of India. By accessing this website, placing an order, or creating an account, you explicitly consent to the terms, limitations of liability, and user duties outlined herein.

2. Strict Purpose Limitation & Data Collection

We process digital personal data solely for lawful, specific purposes required to operate our e-commerce platform.

3. Mandatory Identity Verification for Data Rights

Under the DPDPA, you hold the rights to Access, Correction, Erasure, and Grievance Redressal. However, to protect UNFILTERED from social engineering, data theft, and unauthorized erasure requests:

  • Absolute Right to Deny: We reserve the absolute right to delay, suspend, or deny any request to exercise your data rights if we cannot verify your identity to our absolute satisfaction.

  • Proof Requirement: You may be required to furnish a government-issued ID (e.g., Aadhaar, PAN) or complete Multi-Factor Authentication before we process any request for data erasure or data access.

4. Statutory Data Retention (Superseding Erasure Requests)

Your Right to Erasure is not absolute. UNFILTERED is legally mandated by the Government of India to retain certain records regardless of user consent withdrawal.

  • We will retain all transaction, billing, and shipping data for a minimum of 7 to 8 years to comply with the Goods and Services Tax (GST) Act, Income Tax Act, 1961, and the Companies Act, 2013.

  • Erasure requests targeting data required for active law enforcement investigations, dispute resolution, or fraud prevention will be summarily denied.

5. Absolute Limitation of Liability & Third-Party Processors

UNFILTERED operates on the WordPress/WooCommerce infrastructure and relies on third-party Data Processors. While we ensure our vendors are contractually bound to DPDPA standards, your data is subject to the inherent risks of the internet.

  • Third-Party Immunity: UNFILTERED, its owners, and its Grievance Officer shall hold zero liability for data breaches, leaks, or unauthorized access occurring exclusively on the servers of our third-party partners (including, but not limited to, Razorpay, courier logistics providers, hosting providers, and WooCommerce plugin developers).

  • Account Security: You bear sole legal responsibility for safeguarding your account password and OTPs. UNFILTERED is completely indemnified against any loss, unauthorized purchase, or data exposure resulting from compromised user credentials.

6. Force Majeure (Cyber Security Exemption)

While UNFILTERED employs “reasonable security safeguards” as defined by the DPDPA, we do not warrant that our servers are impenetrable. UNFILTERED shall not be liable for any data breach, loss, or unauthorized processing resulting from events beyond our reasonable control, including but not limited to: state-sponsored cyberattacks, zero-day exploits, acts of God, telecommunication failures, DDOS attacks, or ransomware strikes.

7. Mandatory Duties of the Data Principal (Section 15 DPDPA)

Pursuant to Section 15 of the DPDPA, you are legally bound by strict duties. Violation of these duties subjects you to penalties of up to ₹10,000 enforceable by the Data Protection Board of India. You legally covenant that:

  1. You will never register false, frivolous, or malicious grievances to harass UNFILTERED or its officers.

  2. You will not provide materially false data, fake addresses, or impersonate another individual.

  3. You will not suppress any material information required for lawful transactions.

8. User Indemnification Clause

By using unfilteredufi.com, you agree to fully indemnify, defend, and hold harmless UNFILTERED, its owners, officers, and Nipun Kataria from and against any and all legal claims, penalties, damages, or financial losses arising directly or indirectly from:

  • Your breach of the duties outlined in Section 15 of the DPDPA.

  • Your provision of fraudulent, incorrect, or malicious data.

  • Any unauthorized activity conducted through your user account.

9. Exclusive Jurisdiction & Governing Law

This Privacy Policy and any disputes arising from the processing of digital personal data by UNFILTERED shall be governed exclusively by the laws of the Republic of India.

  • Exclusive Jurisdiction: Any legal action, data tribunal hearing, or judicial proceeding must be instituted exclusively in the competent courts and tribunals located in New Delhi, Delhi, India. You hereby explicitly waive any right to claim a different jurisdiction or forum inconvenience (forum non conveniens).
