This Master Terms of Service (“Agreement”) constitutes a legally binding contract between you (the “User”, “Purchaser”, or “Customer”) and UNFILTERED (“Company”, “we”, “us”, or “our”). By accessing unfilteredufi.com, creating an account, or completing a purchase, you explicitly acknowledge that you have read, understood, and unconditionally agree to be bound by every clause in this Agreement.

IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU ARE STRICTLY PROHIBITED FROM ACCESSING THIS WEBSITE OR PURCHASING OUR PRODUCTS.

1. Legal Capacity to Contract

By utilizing this website, you warrant and represent that you are at least eighteen (18) years of age and possess the legal authority, right, and capacity to enter into binding contracts under the Indian Contract Act, 1872. If you are a minor, you must use this site strictly under the supervision of a legally bound parent or guardian. Any contract formed by a minor is void ab initio, and UNFILTERED reserves the right to terminate accounts suspected of belonging to minors.

2. Absolute Medical, Health & Cosmetic Disclaimer

UNFILTERED retails cosmetic and personal care products. You accept all products on an “As-Is” basis. You explicitly agree to the following conditions precedent:

  • No Medical Claims: The products, descriptions, and materials on this site do not constitute medical or dermatological advice and are not evaluated to diagnose, treat, cure, or prevent any skin condition or disease.

  • Assumption of Risk & Patch Test: Cosmetic ingredients interact differently with varying skin types. It is a mandatory condition of use that you perform a 24-hour patch test prior to full application. You assume 100% of the risk of allergic reactions, chemical sensitivities, breakouts, or adverse physiological responses.

  • Total Liability Release: To the absolute maximum extent permitted by applicable law, UNFILTERED shall bear zero liability for any physical harm, distress, medical expenses, or dermatological issues arising from the use, misuse, or accidental ingestion of our products.

3. Financial Terms, Fraud Prevention & Typographical Errors

  • Pricing & Availability: All prices are in Indian Rupees (INR). UNFILTERED reserves the absolute right to alter prices, revoke offers, or discontinue products at our sole discretion, without prior notice.

  • Typographical Exemption: In the event of a pricing error caused by systemic or typographical malfunction (e.g., a product listed for ₹1 instead of ₹1,000), UNFILTERED reserves the absolute right to cancel and refund any orders placed at the incorrect price, irrespective of order confirmation or payment processing status.

  • Chargeback Fraud: All transactions are processed securely via Razorpay. Initiating a fraudulent “chargeback” or “Item Not Received” claim with your bank while possessing proof of delivery constitutes financial fraud. UNFILTERED reserves the right to pursue civil damages, report the fraud to credit bureaus, and initiate proceedings under the Indian Penal Code (IPC).

4. Shipping, Logistics & Transfer of Risk

  • Third-Party Logistics: Delivery estimates are non-binding guidelines. UNFILTERED is not liable for delays caused by logistics partners, transit accidents, or state-mandated lockdowns.

  • Transfer of Title & Risk: The legal title and risk of loss, damage, or theft for all purchased items pass entirely to you the exact moment UNFILTERED hands the physical package to the third-party courier partner. We are not legally or financially liable for packages marked as “Delivered” that are lost or stolen from your premises.

5. The “Unboxing Video” Evidentiary Standard (Returns & Refunds)

Cosmetics are sanitary consumables. Therefore, all sales are final. Returns or exchanges for “change of mind,” “wrong shade selected,” or “product unsuitability” are strictly prohibited.

  • Damage/Defect Claims: Any claim regarding damaged, defective, or missing items must be registered via email at unfilteredindiaufi@gmail.com within 48 hours of courier delivery timestamp.

  • Mandatory Evidentiary Burden: As a strict condition precedent to any refund or replacement, the Customer must provide a continuous, uncut, and unedited unboxing video. This video must clearly display the intact shipping label, the unbroken seal of the outer packaging, the opening process, and the specific defect.

  • Absolute Right of Refusal: Failure to provide this exact video evidence, or submission of an edited/tampered video, grants UNFILTERED the absolute and unquestionable right to summarily deny the claim.

6. Prohibited Conduct & Business Defamation

You are strictly prohibited from using the site or its content for any unlawful purpose. Furthermore, you agree not to:

  • Deploy bots, spiders, or scrapers to extract data, images, or pricing from our WooCommerce infrastructure.

  • Publish false, malicious, or unverified defamatory statements regarding UNFILTERED, its products, or its owners on social media, review platforms, or public forums. UNFILTERED reserves the right to file civil defamation suits for calculated attacks on its brand reputation resulting in financial loss.

7. Maximum Cap on Financial Liability

Under no legal theory (including tort, contract, strict liability, or negligence) shall UNFILTERED, its proprietor, officers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

  • Hard Financial Cap: If any competent legal authority finds UNFILTERED liable for any actionable grievance, you expressly agree that our total, aggregate maximum liability to you for any and all claims shall be strictly and unequivocally limited to the exact monetary amount you paid to UNFILTERED for the specific product giving rise to the claim.

8. Broad Indemnification

You agree to fully defend, indemnify, and hold harmless UNFILTERED, its proprietor (Nipun Kataria), employees, and affiliates from any and all claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of this Agreement, your misuse of the website/products, or your violation of any third-party rights.

9. Mandatory Arbitration & Governing Law

To prevent frivolous consumer forum harassment, any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach thereof, shall be resolved via private arbitration.

  • Governing Law: This Agreement shall be governed exclusively by the laws of the Republic of India.

  • Binding Arbitration: Disputes shall be referred to a sole arbitrator appointed by UNFILTERED. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996.

  • Seat and Language: The seat and venue of arbitration shall exclusively be New Delhi, Delhi, India. The proceedings shall be in English.

  • Class Action Waiver: You explicitly waive your right to participate in any class-action lawsuit, class arbitration, or consolidated legal action against UNFILTERED.

10. General Provisions (Severability & Entire Agreement)

  • Force Majeure: UNFILTERED shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including acts of God, pandemics, cyber-attacks, government embargoes, or internet infrastructure failures.

  • Severability: If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

  • Entire Agreement: This Agreement constitutes the entire legal understanding between you and UNFILTERED, superseding any prior verbal or written communications, promises, or representations.
